Terms of Service

1. Who you are contracting with

Thumbn is operated by [YOUR FULL NAME], a sole trader trading as Thumbn(“we”, “us”). You can reach us at [SUPPORT@THUMBN.SO], and we will give our postal address on request. We are not a registered company; you are contracting with an individual.

2. The service

Thumbn analyses a video you provide and generates thumbnail images from it using third-party AI models. Output is produced by machine learning systems and varies in quality. We do not promise that any thumbnail will be usable, accurate, unique, or that it will improve your click-through rate.

3. Your account

You sign in with Google. You must be at least 18, or old enough to enter a contract where you live. Keep your account secure — you are responsible for what happens under it. One person per account.

4. What you upload

You keep ownership of the videos and images you upload. You grant us a licence to store and process them solely to provide the service — which includes sending them to the AI providers listed in our privacy policy.

You must have the right to upload what you upload. Do not upload content that infringes someone else’s rights, that is unlawful, or that depicts a real person in a way they have not agreed to.

5. What you get back

Subject to paying your fees, you own the thumbnails Thumbn generates for you and may use them commercially. Two honest limits: AI output cannot be guaranteed original, and in most jurisdictions purely machine-generated images may not attract copyright at all — so we cannot promise you an exclusive right to them.

We may not generate images of real, identifiable people; the underlying models refuse those requests.

6. Acceptable use

You agree not to use Thumbn to:

  • create sexual content involving minors, or non-consensual intimate imagery;
  • impersonate a real person or organisation, or create deceptive deepfakes;
  • infringe copyright, trademarks or another person’s likeness rights;
  • generate content that is unlawful, harassing or incites violence;
  • resell, resupply or automate access to the service without our written agreement;
  • circumvent credit limits, rate limits or the plan gate.

We may suspend or close an account that breaks these rules, without refund.

7. Plans, credits and payment

Access requires an active paid plan. Prices are shown on the site and charged in advance each month through Stripe, who process your card details — we never see them.

Generations consume credits. Monthly plan credits reset at each renewal and do not carry over. Credits bought as one-off packs do not expire. Credits have no cash value and are not refundable or transferable except as set out below or where the law requires.

If you connect your own AI provider API key, generations run on your key and are billed to you by that provider instead of consuming credits. Your plan fee still applies.

8. Cancelling, and your 14-day right to cancel

You can cancel your subscription at any time from the billing page. Cancellation takes effect at the end of the paid period; we do not pro-rate part months.

As a consumer buying at a distance you normally have 14 days to change your mind under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Because Thumbn is digital content supplied immediately, when you start your subscription you ask us to begin supply straight away and acknowledge that you lose that cancellation right once supply has begun. If you have not generated anything, contact us within 14 days and we will refund you.

9. Availability

We aim to keep Thumbn running but do not guarantee uptime. The service depends on third-party AI providers; if one of them fails, changes its terms, or refuses a request, parts of Thumbn may stop working. We may change or withdraw features. If we withdraw the service entirely we will give reasonable notice and refund any unused prepaid period.

10. Our liability

Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — including your statutory rights under the Consumer Rights Act 2015.

Otherwise, we are not liable for lost profit, lost revenue, lost views or lost business, and our total liability to you in any 12-month period is limited to what you paid us in that period.

11. Changes

We may update these terms. If a change materially affects you we will email you before it takes effect. Continuing to use Thumbn after that means you accept the change; if you don’t, cancel and we will refund your unused period.

12. Law and complaints

These terms are governed by the law of England and Wales, and disputes go to its courts. If you live elsewhere in the UK you may bring proceedings in your own country.
